This Privacy Policy explains how personal data submitted through this website — in particular through the Founding Membership application form — is collected and used. It is provided under the EU General Data Protection Regulation (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD).

THE CIRCLE FAMILY CLUB is the name of a pre-launch family club concept. It is not currently a registered company or legal entity, and this website is operated by Ignacio Ortega as Data Controller.
2. Personal data we collect
We only collect the information you enter into the Founding Membership application form, plus limited technical information needed to deliver and de-duplicate your submission.
Required fields:
- Name
- Email address
- Postcode
- Number of children
- Age ranges of your children (0–2, 3–5, 6–8, 9+)
- Which description best fits your family (family profile)
- What would make THE CIRCLE FAMILY CLUB valuable to your family (free text)
- How often you would realistically use the House
- Your reaction to the indicative membership price
Optional fields:
- Telephone number
- School or nursery (optional — you may leave it blank and still submit your application)
- Consent to receive occasional news from THE CIRCLE FAMILY CLUB (optional marketing checkbox)
Technical information collected with your submission:
- Campaign source parameters (
utm_source,utm_medium,utm_campaign) — only when those parameters are present in the link you used to reach this website, so we can understand which channels families found us through - A random submission reference generated in your browser, used only to prevent the same application being emailed twice
- The date and time of your submission and the version of the privacy notice shown to you at that moment, kept as a record of the information you were given and of any marketing consent
- An anti-spam "honeypot" field, which is always empty for real applicants
We do not ask you for your identity document, financial details, health information or any special category of personal data. We do not build advertising profiles and we do not use automated decision-making that produces legal effects.
3. Founding Membership applications
Purpose: to receive your Founding Membership application, to manage and assess it, to respond to you, and to contact you about your application and the pre-opening steps that follow from it (for example inviting you to a private preview).
Legal basis: processing necessary in order to take steps at your own request prior to entering into a possible membership relationship (Article 6(1)(b) GDPR). Where a specific step goes beyond that, we rely on our legitimate interest in developing and validating THE CIRCLE FAMILY CLUB as a concept (Article 6(1)(f) GDPR).
You do not need to consent to marketing in order to apply. Your application is processed on the basis above whether or not you tick the optional marketing checkbox.
4. Marketing communications
Purpose: to send you occasional communications about the launch of THE CIRCLE FAMILY CLUB, Founding Membership, events, activities and other relevant updates.
Legal basis: your consent, given by ticking the optional marketing checkbox on the form (Article 6(1)(a) GDPR, in conjunction with Article 21 of Spanish Law 34/2002 on information society services and electronic commerce, LSSI).
This checkbox is optional and is never pre-ticked. If you do not tick it, we will not send you promotional communications — we will only contact you about your application.
You can withdraw your consent at any time, free of charge, by emailing circlefamilyclub@gmail.com. Withdrawing consent does not affect the lawfulness of communications already sent, and does not affect the handling of your application.
5. Market-validation analysis
THE CIRCLE FAMILY CLUB is at a pre-launch validation stage. We use the information from applications to understand demand — for example the geographic spread of postcodes, the age ranges of children, family profiles, expected frequency of use and which services families value most.
Wherever possible we carry out this analysis on aggregated or anonymised information rather than at individual level, and we do not create unnecessary individual profiles. The legal basis for this analysis is our legitimate interest in assessing whether and where to open the first House (Article 6(1)(f) GDPR).
6. How long we keep your data
- Founding Membership applications: kept for as long as needed to manage the validation and launch of THE CIRCLE FAMILY CLUB. Where no membership relationship is established, applications are normally kept for a maximum of approximately 12 months from submission, unless you ask us to delete them earlier, a longer retention period is legally required, or an ongoing relationship with you justifies keeping them.
- Marketing consent and marketing contact details: kept until you withdraw your consent, until the marketing purpose ends, or until continued retention is no longer justified. A record that consent was given or withdrawn may be kept for a reasonable period afterwards in order to demonstrate compliance.
We do not keep your personal data indefinitely.
7. Service providers who process data for us
We keep the number of providers to a minimum. The following providers process personal data on our behalf as processors:
- Netlify (Netlify, Inc.) — website hosting, content delivery and execution of the serverless function that handles your form submission. Netlify also stores a backup copy of form submissions where its form-handling feature is enabled.
- Resend (Resend, Inc.) — email infrastructure used to deliver your application to the Data Controller's inbox.
- Google (Google Ireland Limited / Google LLC) — the mailbox circlefamilyclub@gmail.com, in which your application email is received and stored.
We do not sell your personal data and we do not share it with advertising networks. We do not use a CRM, a database or an email-marketing platform for this website.
8. International data transfers
Some of the providers listed above are established in the United States or may process data on infrastructure located outside the European Economic Area (EEA). We therefore cannot state that all data remains in Spain or in the EU.
Where personal data is transferred outside the EEA, the transfer is made subject to the safeguards required by Chapter V of the GDPR, as set out in the data processing terms of the provider concerned. You can request further information about the transfer mechanism applicable to a specific provider by writing to circlefamilyclub@gmail.com.
9. Your rights
You have the right to:
- Access your personal data;
- Rectify inaccurate or incomplete data;
- Erasure ("right to be forgotten") of your data;
- Restrict our processing of your data;
- Object to processing based on legitimate interest;
- Data portability, where applicable;
- Withdraw your marketing consent at any time, without affecting your application.
To exercise any of these rights, email circlefamilyclub@gmail.com. We may ask you for information to confirm your identity before acting on a request.
10. Complaints
If you believe your data-protection rights have not been respected, you can lodge a complaint with the Spanish supervisory authority, the Agencia Española de Protección de Datos (AEPD): www.aepd.es. We would appreciate the chance to resolve the matter with you first.
11. Children's data
The Founding Membership form is intended to be completed by adults — parents or legal guardians. We do not knowingly ask children to submit personal information about themselves.
The form does collect limited information about family composition: the number of children, their age ranges, and optionally the school or nursery they attend. We deliberately minimise this: we do not ask for children's names or surnames, dates of birth, health information, photographs, class, teacher, school ID or any other information identifying an individual child. Please do not include such details in the free-text fields.
12. Cookies and browser storage
This website does not use analytics, advertising, social-media or behavioural tracking technologies. It does not set cookies, and it does not store information in your browser's local storage or session storage. For this reason no cookie-consent banner is displayed.
The language you choose with the site's language selector is carried only in the web address (for example ?lang=es), so that the pages you open next stay in the same language. It is not saved on your device and it is not sent to us.
If campaign parameters are present in the link you use to reach the site, they are read from the address in your browser and sent only as part of the application you choose to submit — they are not stored on your device.
If this changes in the future — for example if analytics are introduced — this policy will be updated and an appropriate consent mechanism will be implemented before any non-essential technology is loaded.
13. Changes to this policy
We may update this Privacy Policy to reflect changes to the website or to legal requirements. The date at the top of this page shows when it was last updated. The version of the notice shown at the moment of your submission is recorded with your application.
Esta Política de Privacidad explica cómo se recogen y utilizan los datos personales facilitados a través de esta web y, en particular, a través del formulario de solicitud de Founding Membership. Se facilita conforme al Reglamento General de Protección de Datos de la UE (RGPD) y a la Ley Orgánica 3/2018 de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD).

THE CIRCLE FAMILY CLUB es la denominación de un concepto de family club en fase previa a su apertura. Actualmente no es una sociedad ni una entidad jurídica constituida, y esta web es gestionada por Ignacio Ortega en calidad de Responsable del tratamiento.
2. Datos personales que recogemos
Solo recogemos la información que introduces en el formulario de solicitud de Founding Membership, junto con la información técnica mínima necesaria para entregar tu solicitud y evitar envíos duplicados.
Campos obligatorios:
- Nombre
- Código postal
- Número de hijos
- Rangos de edad de los hijos (0–2, 3–5, 6–8, 9+)
- Descripción que mejor encaja con vuestra familia (perfil familiar)
- Qué haría que THE CIRCLE FAMILY CLUB fuera valioso para vuestra familia (texto libre)
- Con qué frecuencia utilizaríais la Casa de forma realista
- Tu valoración del precio indicativo de la membresía
Campos opcionales:
- Teléfono
- Colegio o nursery (opcional: puedes dejarlo en blanco y enviar igualmente tu solicitud)
- Consentimiento para recibir novedades ocasionales de THE CIRCLE FAMILY CLUB (casilla de marketing opcional)
Información técnica recogida con tu solicitud:
- Parámetros de origen de campaña (
utm_source,utm_medium,utm_campaign), únicamente cuando dichos parámetros están presentes en el enlace desde el que has llegado a la web, para entender por qué canales nos encuentran las familias - Una referencia aleatoria de envío generada en tu navegador, utilizada solo para evitar que la misma solicitud se envíe dos veces por email
- La fecha y hora de tu envío y la versión del aviso de privacidad que se te mostró en ese momento, conservadas como registro de la información facilitada y del consentimiento de marketing, en su caso
- Un campo "honeypot" anti-spam, que en solicitudes reales siempre queda vacío
No solicitamos documento de identidad, datos financieros, información de salud ni ninguna categoría especial de datos personales. No elaboramos perfiles publicitarios ni aplicamos decisiones automatizadas con efectos jurídicos.
3. Solicitudes de Founding Membership
Finalidad: recibir tu solicitud de Founding Membership, gestionarla y evaluarla, responderte y contactar contigo en relación con tu solicitud y con los pasos previos a la apertura que se derivan de ella (por ejemplo, invitarte a un private preview).
Base jurídica: tratamiento necesario para aplicar medidas precontractuales adoptadas a tu propia solicitud, con vistas a una posible relación de membresía (artículo 6.1.b RGPD). Cuando alguna actuación concreta vaya más allá de lo anterior, nos basamos en nuestro interés legítimo en desarrollar y validar THE CIRCLE FAMILY CLUB como concepto (artículo 6.1.f RGPD).
No es necesario consentir el envío de comunicaciones comerciales para poder solicitar la membresía. Tu solicitud se tramita conforme a la base jurídica anterior, marques o no la casilla opcional de marketing.
4. Comunicaciones comerciales
Finalidad: enviarte comunicaciones ocasionales sobre el lanzamiento de THE CIRCLE FAMILY CLUB, la Founding Membership, eventos, actividades y otras novedades relevantes.
Base jurídica: tu consentimiento, otorgado al marcar la casilla opcional de marketing del formulario (artículo 6.1.a RGPD, en relación con el artículo 21 de la Ley 34/2002 de servicios de la sociedad de la información y de comercio electrónico, LSSI).
Esta casilla es opcional y nunca aparece premarcada. Si no la marcas, no te enviaremos comunicaciones promocionales: únicamente contactaremos contigo en relación con tu solicitud.
Puedes retirar tu consentimiento en cualquier momento y de forma gratuita escribiendo a circlefamilyclub@gmail.com. La retirada del consentimiento no afecta a la licitud de las comunicaciones ya enviadas ni a la gestión de tu solicitud.
5. Análisis de validación de mercado
THE CIRCLE FAMILY CLUB se encuentra en una fase de validación previa al lanzamiento. Utilizamos la información de las solicitudes para entender la demanda: por ejemplo, la distribución geográfica de los códigos postales, los rangos de edad de los niños, los perfiles familiares, la frecuencia de uso prevista y qué servicios valoran más las familias.
Siempre que es posible realizamos este análisis sobre información agregada o anonimizada, y no a nivel individual, y no creamos perfiles individuales innecesarios. La base jurídica de este análisis es nuestro interés legítimo en evaluar si conviene abrir la primera Casa y dónde (artículo 6.1.f RGPD).
6. Plazos de conservación
- Solicitudes de Founding Membership: se conservan durante el tiempo necesario para gestionar la validación y el lanzamiento de THE CIRCLE FAMILY CLUB. Cuando no se establece una relación de membresía, las solicitudes se conservan normalmente durante un máximo de aproximadamente 12 meses desde su envío, salvo que solicites su supresión antes, que sea legalmente exigible un plazo mayor, o que una relación continuada contigo justifique su conservación.
- Consentimiento y datos de contacto para marketing: se conservan hasta que retires tu consentimiento, hasta que finalice la finalidad de marketing o hasta que su conservación ya no esté justificada. El registro de la concesión o retirada del consentimiento puede conservarse durante un plazo razonable posterior para poder acreditar el cumplimiento normativo.
No conservamos tus datos personales de forma indefinida.
7. Proveedores que tratan datos por nuestra cuenta
Mantenemos el número de proveedores al mínimo. Los siguientes proveedores tratan datos personales por nuestra cuenta, en calidad de encargados del tratamiento:
- Netlify (Netlify, Inc.): alojamiento de la web, distribución de contenidos y ejecución de la función serverless que procesa el envío del formulario. Netlify también almacena una copia de respaldo de los envíos cuando su funcionalidad de formularios está activada.
- Resend (Resend, Inc.): infraestructura de email utilizada para entregar tu solicitud al buzón del Responsable del tratamiento.
- Google (Google Ireland Limited / Google LLC): el buzón circlefamilyclub@gmail.com, en el que se recibe y almacena el email con tu solicitud.
No vendemos tus datos personales ni los compartimos con redes publicitarias. Esta web no utiliza CRM, base de datos ni plataforma de email marketing.
8. Transferencias internacionales de datos
Algunos de los proveedores indicados están establecidos en Estados Unidos o pueden tratar datos en infraestructuras situadas fuera del Espacio Económico Europeo (EEE). Por tanto, no podemos afirmar que todos los datos permanezcan en España o en la UE.
Cuando se transfieren datos personales fuera del EEE, la transferencia se realiza con sujeción a las garantías exigidas por el Capítulo V del RGPD, en los términos previstos en las condiciones de tratamiento de datos del proveedor correspondiente. Puedes solicitar información adicional sobre el mecanismo de transferencia aplicable a un proveedor concreto escribiendo a circlefamilyclub@gmail.com.
9. Tus derechos
Tienes derecho a:
- Acceso a tus datos personales;
- Rectificación de datos inexactos o incompletos;
- Supresión ("derecho al olvido") de tus datos;
- Limitación del tratamiento;
- Oposición al tratamiento basado en el interés legítimo;
- Portabilidad de los datos, cuando resulte aplicable;
- Retirar el consentimiento de marketing en cualquier momento, sin que ello afecte a tu solicitud.

10. Reclamaciones
Si consideras que tus derechos en materia de protección de datos no han sido respetados, puedes presentar una reclamación ante la autoridad de control española, la Agencia Española de Protección de Datos (AEPD): www.aepd.es. Te agradeceríamos la oportunidad de resolverlo contigo previamente.
11. Datos de menores
El formulario de Founding Membership está destinado a ser completado por personas adultas: padres, madres o tutores legales. No solicitamos conscientemente que los menores faciliten información personal sobre sí mismos.
El formulario sí recoge información limitada sobre la composición familiar: el número de hijos, sus rangos de edad y, opcionalmente, el colegio o nursery al que acuden. Minimizamos deliberadamente esta información: no pedimos nombres ni apellidos de los niños, fechas de nacimiento, información de salud, fotografías, clase, profesor, identificador escolar ni ningún otro dato que identifique a un menor concreto. Te pedimos que no incluyas ese tipo de detalles en los campos de texto libre.
12. Cookies y almacenamiento en el navegador
Esta web no utiliza tecnologías de analítica, publicidad, redes sociales ni seguimiento del comportamiento. No instala cookies ni almacena información en el almacenamiento local o de sesión de tu navegador. Por este motivo no se muestra ningún banner de consentimiento de cookies.
El idioma que eliges con el selector de idioma de la web se transmite únicamente en la dirección web (por ejemplo ?lang=es), para que las páginas que abras a continuación se mantengan en el mismo idioma. No se guarda en tu dispositivo ni se nos envía.
Si el enlace por el que llegas a la web incluye parámetros de campaña, estos se leen de la dirección en tu navegador y se envían únicamente como parte de la solicitud que decides enviar; no se almacenan en tu dispositivo.
Si esto cambiara en el futuro —por ejemplo, si se incorporase analítica— esta política se actualizará y se implementará un mecanismo de consentimiento adecuado antes de cargar cualquier tecnología no esencial.

Podemos actualizar esta Política de Privacidad para reflejar cambios en la web o en la normativa aplicable. La fecha que figura al inicio de esta página indica cuándo se actualizó por última vez. La versión del aviso mostrada en el momento de tu envío queda registrada con tu solicitud.
